1. Agreement to Terms

By creating an account on Hampton Roads Home Services ("HRHS," "we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

2. Description of Service

HRHS operates a two-sided online marketplace connecting homeowners in the Hampton Roads region of Virginia with licensed and insured home service professionals ("Providers"). We facilitate introductions and communications between parties but are not a party to any agreement between homeowners and Providers, nor are we a contractor or employer of any Provider.

3. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use this platform. By using HRHS, you represent and warrant that you meet these requirements. Accounts created on behalf of a business entity must be authorized by that entity.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. HRHS reserves the right to suspend or terminate accounts that contain false or misleading information.

5. Provider Responsibilities

Providers represent and warrant that they (a) hold all licenses, certifications, and insurance required by applicable law to perform the services they offer; (b) will accurately describe their qualifications and services; (c) will respond to job inquiries in a timely and professional manner; and (d) will honor the terms of any agreement made with a homeowner through the platform. HRHS does not independently verify every credential. Admin-verified badges indicate documentation has been reviewed by HRHS staff.

6. Homeowner Responsibilities

Homeowners agree to (a) provide accurate descriptions of the work requested; (b) respond to Provider bids within a reasonable timeframe; (c) pay Providers directly and promptly upon satisfactory completion of work; and (d) leave honest, good-faith reviews of services received.

7. Fees and Billing

HRHS offers free and paid subscription tiers. Free accounts are subject to usage limits. Paid subscriptions are billed on a recurring basis through our payment processor. All fees are non-refundable except as required by law or at HRHS's sole discretion. Failure to maintain a valid payment method may result in restriction or termination of paid features.

8. Prohibited Conduct

You agree not to: (a) post false, misleading, or defamatory content; (b) solicit or accept payment outside the platform in a manner intended to circumvent fees; (c) harass, threaten, or abuse other users; (d) use automated tools, bots, or scrapers on the platform; (e) post content that infringes any intellectual property right; (f) attempt to gain unauthorized access to any part of the platform or other users' accounts.

9. Reviews and Content

By submitting reviews, photos, job descriptions, or other content, you grant HRHS a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with operating the platform. You represent that you own or have the right to share all content you submit. HRHS reserves the right to remove any content that violates these Terms or our Community Guidelines.

10. Dispute Resolution

Disputes between homeowners and Providers are solely between those parties. HRHS may, at its discretion, facilitate communication or mediation but is not obligated to do so. Any dispute between you and HRHS shall be resolved by binding arbitration in Virginia Beach, Virginia, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

11. Limitation of Liability

HRHS is provided "as is" without warranties of any kind. To the fullest extent permitted by law, HRHS disclaims all warranties, express or implied. In no event shall HRHS be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, even if advised of the possibility of such damages. Our total liability to you shall not exceed the greater of $100 or the fees paid by you to HRHS in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless HRHS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the platform, your violation of these Terms, or your interactions with other users.

13. Privacy

Your use of HRHS is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the collection and use of information as described in our Privacy Policy.

14. Modifications

HRHS reserves the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the platform. Your continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict-of-law provisions.
